Kevin Kwek

Kevin Kwek graduated from the University of Keele, England in 1993 with
a Second Class (Upper) Honours Degree in Law and Economics. Kevin graduated in the top 10% of his law graduating class.
Kevin was admitted as a Barrister-at-Law of the Middle Temple, England in 1994 and was subsequently called to the Singapore Bar in June 1995. He has worked in some of the largest law firms in Singapore prior to setting up Legal Solutions LLC.

Areas of Practice
Kevin’s area of practice covers dispute resolution, in the form of litigation, mediation and arbitration both under the ICC and SIAC Rules. His practice includes disputes in relation to Shipping, Banking and Commercial Transactions, Company Law matters including Corporate and Shareholder disputes, Insurance Law, matters
involving Management Corporations, Professional Negligence, Employment Law, Construction Law and Equity and Trusts. Some of the reported cases Kevin has handled
have also contributed to the jurisprudence in Singapore. He is also a tutor with the Singapore Institute of Legal Education which is a post graduate course that aspiring lawyers have to take in order to be called to the Singapore Bar, where he tutors on an aspect of civil procedure.
Experience
Some matters of significance in which Kevin has been involved in, include:
• Acted for one of the Big Four accounting firms who were the Receivers and Managers of one of the top palm oil refiners in Malaysia in claiming in contract against a local company for various breaches of contract.
• Acted for one of the world’s largest ship builders both at first instance and on appeal to the Court of Appeal in relation to a dispute regarding a joint venture agreement with one of the world’s largest offshore marine construction company in the oil and gas industry and successfully obtained in injunction preventing them from entering into a contract with a rival company.
• Acted for a Korean Fortune 500 company who were the shippers of a cargo against the ship owners in a claim for wrongful delivery which is one of the seminal cases in Singapore on the legal effect of a holder of a bill of lading. The judgment in favour of the client was also upheld by the Court of Appeal.
• Acted for a company on an insurance claim involving an All Risks’ Policy.
• Acted for a prominent dentist in one of the few cases in Singapore on a review of a Dental Board’s decision to strike off a dentist from the Rolls.
• Acted for various parties in a SIAC Arbitration which took place in both Singapore and Los Angeles in relation to a $25m dispute over the construction of a state-of-the-art desalination plant.
• Acted for a foreign bank in Singapore on various multi-currency overdraft facilities against a high net worth individual.
• Acted for a prominent Singaporean in a high profile major high court action involving breach of contract of various well known local trade marks involving actions both in Singapore and Malaysia.
• Acted for a Management Corporation against a previous managing agent claiming in negligence.
• Acted for various Management Corporations in their claims for defects to the common property against the Developer, Main Contractor and the Architect of the Condominium.
• Acted for an International Insurance company where he spearheaded its worldwide recovery efforts against one of the world’s largest paper and pulp producers who was involved in one of the world’s largest debt restructuring exercises, restructuring debts worth more than US$16 billion.
• Acted in a shareholders’ dispute involving a private limited company in Singapore and prosecuted the claim based on minority oppression.
• Acted in a defamation action in Singapore where he represented several Members of Parliament in an action against a well-known politician.
